Procedure to change your name legally


Overview: People change their names for a variety or reasons including astrological and numerological reasons, women change their first names after marriage in certain cases, adopt the surname of their husbands etc. in certain cases, people change names simply because they don’t like them. For other cases, it may be because of mismatch in documents. There are certain countries like the USA which prefer to have a person’s surname in their passports.

Purpose: The purpose of this article is to serve as a guide to change your name legally so that all documents can thereafter bear a same name and any confusion whatsoever can be avoided. Please remember that you can change your name or surname or both however, this cannot be done multiple times.

Areas of Application of Law: No specific law as such. It is simply a procedure

Process:

Step 1: preparing the affidavit:

 

Visit your local notary and ask him to prepare the affidavit on the stamp paper of required value. Thereafter include the following details in the affidavit-

       (i) Name and New name;

       (ii) Current address
       (iii) Reason for name change (Astrology, numerology, marriage, etc)

Once the affidavit is printed on a plain stamp paper, it needs to be signed by two witnesses. Better to get it signed by two persons of gazette officer rank. Ensure that you have their signature, along with their stamp (rubber stamp).

For an employee of central government employee has to done in accordance with the Ministry of Home Affairs O.M. No. – 190016/1/87-Estt. Dated 12.03.1987. Ask the Notary for advice or do a general google search.

Married women who opt for change in name or surname have to give the following details:
         (i) Old name with the father’s name and address;

         (ii) New name with husband’s name and address; along with the date of marriage.

Please note that the affidavit must show both your new as well as old name. Retain a copy of the affidavit for any future legal use.

Step 2: Publication in newspaper

Choose two newspapers, one published in the official language of the state and the other, an English daily and give an advertisement about your change of name. give the following details: Your new and old name, date of birth, address, father’s name and age

 

Step 3: Publication in the gazette

 

After publication of the gazette notification is done then, your name change will be legally complete.

Get a ‘Deed changing name form’ available with the Controller of Publication, Department of Publication or a letter of declaration from you, stating the need for changing the name;

Have original copies of both advertisements published with the date handy. And attach them

Also have attested photographs ready with yourself along with address proof which should be the same as the one published in the newspaper and affidavit. In case your address is different then your application may be rejected.

Do pay a visit to the controller’s office or give them a call to check if anything else is required.

 

Better to do this process in person rather than sending it through post or courier. Requisite fee has to be paid.

 

Now your name is changed!

 

Documents required to be submitted in the court if any: The documents are not to be submitted to any court generally. But you are required to keep copies of your notorised affidavit, copies of the name change ads published in the news paper and the ad published in the official gazette with yourself as they are required for the purposes of obtaining fresh documents like passport, Aadhaar card, PAN card etc. after the change of name.

Punishment/Expected Relief: Your name is changed to a new name and thereafter you can apply for any document including passport, Aadhaar card etc. in your new name. You get a new identity as far as your name is concerned.
