Madras HC issues notice to State Government to set the online RTI portal

Madras HC is hearing a petition requesting for the set up of online RTI portal in all Government departments of the State. The petitioner filed a PIL proposing the facilities under Right to Information Act should be accessible via the Internet for the convenience of citizens.

Advocate Fathima Sulthana on behalf of petitioner argued that Right to Information Act does have provision for the establishment of the online portal. Still, Out of all States, Maharashtra is the only one who has taken necessary actions to provide RTI online Services.

The petitioner also outlined the provision of Section 4(1)B of the RTI Act, under which the State’s Government departments are compelled to provide information regarding their organizational structure, powers, duties, function, classification of documents and decision making process within 120 days from the commencement of Act. Still, no such information has ever been provided by the State  Government of Tamil Nadu till date.

The petitioner also proposed that the concept of online RTI portal can also be adopted by Tamil Nadu Government, similar to the Maharashtra who already have their online portal in this regard. The National Informatics Center provided technical support to Maharathra in the establishment, administration and supervision of their Online portal, can also be done in Tamil Nadu.

The petitioner suggested that online portal would increase transparency, provide comfort to Public information providers, reduce paper work, and save public expenses that would be lost in transit of information.

The petitioner also outlined a self made the previous appeal on May 12, 2017, to the State Government of Tamil Nadu and to the bench of Chief Minister, requesting for the discloser of Government information and to set up the online RTI Portal, but no positive response was received at that time.

The State Government payed no heed in this regard till today, due to the reason the petitioner moved to the  High Court, seeking its intervention to direct State Government to set up the online portal as per the RTI rules.
