No proposal to provide school bags in primary classes under RTE Act: DoE to Court

The Directorate of Education, Delhi refused to provide school bags or money in the lieu of schools bags, to the elementary class students of civic schools as they already are bearing the expenses of their uniforms and stationary materials from class I to VIII. They also underlined that no such provision is mentioned in the Right to Education Act that mandates Delhi Government to supply schools bags.

Directorate of Education filed an Affidavit in response to the Delhi High Court’s order to explore the possibility of providing school bags to the poor students of primary classes of Municipal Schools. The case will be heard tomorrow before the Bench comprising Justice Indermeet Kaur.

The petition filed by three minor students condemning Delhi Government and Municipal Corporation of Delhi of allegedly not following the Rules of Delhi Right Children to Free and Compulsory Education.

Advocate Ashok Agarwal representing the petitioner argued that students of primary classes in Government Schools were not given any subsidy for uniforms and study material despite the academic year nearing to end and suggested that Government should provide schools bags as many don’t have any to keep their books.

That so far the supply of schools bags to the students is concerned, it is pertinent to mention that answering respondent (DoE) has no proposal of providing school bags or money in the lieu of it, since there is nothing mention in the Right to Education Act that envisages the provision of supply of school bags, written in the affidavit submitted by the DoE in response to court’s enquiry.
