ARBITRATION PROCEDURE

In India, Arbitration is governed by the Arbitration and Conciliation Act. The law states that in order to adopt arbitration as an Alternative Dispute Resolution (ADR) mechanism, the disputing parties must sign an agreement to that effect.

The parties can either opt for a separate arbitration agreement to be signed by them or include an arbitration clause in the main contract.


The present document focuses mainly on the detailed procedure as to how arbitration is carried out.
