The Supreme Court sets to hear petition requesting the ownership of Babri Masjid to Shia Muslims

Shia Waqf Board of Uttar Pradesh filed a writ petition challenging the seventy-two years old judgment of Trial Court in which the ownership of Babri Masjid was declared to the Sunni Waqf Board. After losing the battle on the date of March 30, 1946, Shia Waqf Board moved to Supreme Court on Wednesday, seeking its direction to commence retrial on the issue.

The Board has admitted in the petition that the Babri Masjid was constructed by Babur’s Minister Abdul Mir Baqi, after demolishing a Temple on the site. He invested his own funds for the construction process.

Shia Waqf Board appealed SC to throw some light on this petition along with the Ram Janam Bhoomi-Babri Masjid dispute which is scheduled for hearing on Friday.

The petition filed by Advocate MC Dhingra, representing Shia Waqf Board challenged the Seventy years old decision on the grounds that Mir Baqi was a Shia Muslim who constructed the mosque. Now, Babur ordered his Minister to demolish the temple and construct a mosque instead of it. The order was given by Babur, a Sunny Muslim to Mir Baqi, a Shia Muslim.

Babur only stayed in Ayodhya for 5-6 days whereas the construction of Mosque took time and merely ordering to construct a mosque doesn’t make him the owner of the Masjid. It was Baqi who picked the site for Mosque and invested from his own funds for the construction, making him the actual Wakif of the Mosque, the petition said.

The Babri Masjid was under the superintendence of Shia Muslims until the trial court declared it as the property of sunny Muslims in 1946. The Shia Waqf Board board approached the Civil Court of Faizabad in 1945 after the British Government had mistakenly parted it with Sunny Muslims. A year after the claim for the sole ownership of Bari Masjid to Shia Muslims was dismissed.

The Supreme Court is all determined to hear the case between both boards of Muslim Community as Shia board has already accused its rival of protesting against the efforts of bringing a harmonious resolution in the Ram Janam Bhoomi-Babri Masjid case.
