Babri demolition case: L K Advani, Uma Bharti and MM Joshi granted bail by CBI court

 The special CBI court is all set to begin hearing in the Babri Masjid demolition case, which will determine the fate of BJP veteran leaders, LK Advani, MM Joshi, Cabinet minister Uma Bharti and nine others who were suspected to have been involved in the knitting conspiracies responsible for the destruction of the mosque. 

All the accused, including Advani, Bharti and Joshi, have been granted bail against a personal bond of Rs 50,000. The CBI court had earlier said it would frame additional charges against LK Advani and the others.

All of the accused were to appear before the special court on May 25 and 26, but all 12 had sought an exemption for the day. Though the court complied with the request of the accused, it cautioned the whole lot that no further exemptions will be allowed.

Some of the others who are expected to appear before the court are BJP MP Vinay Katiyar, Sadhvi Ritambara, Vishnu Hari Dalmiya, Ramjanmabhoomi Trust chief Nritya Gopal Das, Ram Vilas Vedanti, Baikunth Lal Sharma, Champat Rai Bansal, Dharma Das and Satish Pradhan.

All of the aforementioned names featured in the FIR filed after the demolition of the Babri Masjid on December 6, 1992, for instigating mobs, rioting and for orchestrating the destruction of the now-disputed Masjid.

While the accused in the case thought they were “safe” when Allahabad High Court upheld the judgement – dropping conspiracy charges - awarded to all the accused by a trial court in 2001.

However, the Supreme Court on April 19, 2017, revived the conspiracy charges, directing the special CBI court to frame fresh charges within a month from the date of production of the order before it. With pressure from the top court, the CBI court is looking to frame the charges quickly and start the daily trial that may continue over a period of two years.

The CBI had earlier approached the Supreme Court challenging the trial court order of dropping conspiracy charges against over a dozen BJP and right-wing Hindu leaders including L K Advani, Uma Bharti and M M Joshi in the Babri demolition case. 

SC revived the conspiracy charges on April 20. The charges were to be framed within four weeks and SC had directed a day to day hearing of the case so it can be decided within two years. However, Kalyan Singh's trial has been deferred as he enjoys Constitutional immunity as Rajasthan Governor.
