Supreme Court to pronounce verdict on Aadhaar, quota in SC/ST promotion and live streaming of court proceedings today

The Supreme Court is likely to pronounce its verdict in several significant cases today, including the constitutional validity of the Centre’s flagship Aadhaar scheme, reservation in promotion for SCs and STs in govt employment and whether or not live streaming should be introduced in other courts of the apex court.

The constitution bench of the Supreme Court, comprising CJI Dipak Misra and Justices AK Sikri, AM Khanwilkar, DY Chandrachud and Ashok Bhushan, will decide on many important cases today.

The Aadhaar Case

The constitution bench had on May 10 reserved its verdict on a batch of petitions challenging the constitutional validity of Aadhaar after a marathon hearing which went for over 38 days starting January 17 this year.

Reportedly, over 30 petitions have been filed challenging the Aadhaar act as the government made it compulsory for linking Aadhaar card with bank accounts, mobile phone numbers, permanent account numbers and filing of income taxes to the unique ID number.

The petitions alleged that linking Aadhaar card, to every important official and government documents, violated the right to privacy, which the apex court confirmed as a fundamental right in a nine-judge bench verdict on August 2017.

Reservation in Promotion for SCs/STs employees

A five-judge Constitution Bench, comprising CJI Dipak Misra and Justices Kurian Joseph, RF Nariman, S K Kaul and Indu Malhotra, had reserved its verdict on August 30 on petitions seeking a seven-bench examination of its judgment in the M Nagaraj case.

In the M Nagaraj case, the Supreme Court had put conditions for granting quota benefits in promotions to SC/ST employees.

Live Streaming of Court Proceedings

A three-judge bench of the Supreme Court, comprising Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud, had on August 24 reserved its verdict on a clutch of petitions seeking live streaming and video recording of court proceedings to be introduced in all courts across the country.

The bench then observed, “We don't perceive any difficulty in live streaming. Let us first start with it and see how it goes. We are just on a pilot project. We are not ruling out anything and will improve with time. We cannot have everything together.”
