Supreme Court gives nod to government to probe against ED official investigating Aircel-Maxis case

The Supreme Court modified its earlier order on Wednesday that has barred the government from taking action against the ED officer Rajeshwar Singh probing the Aircel-Maxis case, and gave its nod to the Centre to probe into allegations against the official.

The court’s decision came after the government through the Additional solicitor general Vikramjit Banerjee placed a report in a sealed envelope before a vacation bench of Justices Arun Mishra and Sanjay Kishan Kaul.

Banerjee handed over the report immediately as the bench commenced hearing a plea filed by BJP leader Subramanian Swamy, who sought to become a party in the hearing of a case filed against Singh by one Rajneesh Kapoor.

The bench after perusing the documents in the envelope said that the allegations levelled against Rajeshwar Singh were serious and needed to be looked into. And it will be the government’s call whether Singh will be further required in the Aircel Maxis case or not, the court said.

“As a matter of fact, when there are allegations, whether right or wrong against you (Singh), it has to be looked into,” the bench said, adding, “The things which have come before us are startling”, the bench said.

The bench further told Singh, “You are simply an officer. You can’t be given a blanket clean chit. Everybody is accountable. You must be accountable for any action. We need to ensure that you are accountable. We don’t want to damage you or comment against you. There are very serious allegations against you”.

The SC bench said it would pass an appropriate order regarding the matter at 2 pm on Thursday.
