SC adjourns Swamy’s plea in the Aircel-Maxis case till tomorrow

A vacation bench of the Supreme Court has adjourned for tomorrow a plea filed by BJP leader Subramanian Swamy.

In the plea, Swamy has sought to be impleaded in the PIL filed against an Enforcement Directorate (ED) officer, Rajeshwar Singh, probing the Aircel-Maxis deal. The PIL was filed by Rajneesh Kapur, who alleged that the ED officer has amassed disproportionate assets.

During the hearing, the SC bench found neither the petitioner nor his counsel present in person. Thus, the court adjourned the hearing to Wednesday.

The bench also asked Swamy whether the copy of his petition was served upon the petitioner or not.

In response, Swamy told the court that the petition copy had been served, but despite that no one has appeared on behalf of the petitioner.

Following this the bench said, “Then we will take up the matter tomorrow and you serve the copy of application and even personally inform him for appearing tomorrow”.

The top court further said that it will also hear the contempt plea filed by Rajeshwar Singh against Kapur tomorrow. In the petition, Singh had sought to initiate contempt proceedings as attempts have been made to prevent the ongoing probe in the Aircel-Maxis case.

Swamy, who had previously moved the top court seeking an expeditious investigatation in the Aircel-Maxis case, has sought court’s direction for making himself as a party in the case filed against the ED official.

Justice Indu Malhotra on June 20 recused herself from hearing the petition filed in the Aircel-Maxis case without assigning any reason – after Swamy asked for intervention in the writ petition.

The Supreme Court had, on March 12, laid down a deadline of six months for the CBI and the ED official to complete the probe into the alleged irregularities in the FIPB approval given in the Aircel-Maxis deal case wherein the former finance minister Chidambaram and his son Karti were questioned by the investigative agencies.
