Ministry of Law & Justice invites suggestion on Draft Mediation Bill, 2021

The Draft Mediation Bill, 2021, was placed on public domain by the Ministry of Law & Justice, in order to receive feedback and suggestions from all stakeholders.

 

This act entails to encourage community mediation, to make online mediation acceptable and cost effective process or with matters connected to or identical matters, to promote and facilitate institutional mediation for commercial dispute resolution, enforcing domestic and international mediation settlement agreements, provide for registration of mediators.

 

Mediation refers to a process in which parties request the assistance of a third person or persons (the mediator) in their attempt to attain an amicable resolution of a conflict, whether referred to by the terms mediation, pre-litigation mediation, online mediation, conciliation, or an expression of similar import.

 

The provisions within the act will come in force when the Central Government by notification in the official gazette may be appointed and different dates may be appointed for different provisions of this Act. Any reference in any provision in reference to the commencement of this act shall be constructed as coming into force of that provision.

 

Lok Adalat and Permanent Lok Adalat shall conduct mediation in accordance with the provisions of the Legal Services Authorities Act, 1987, and  rules or regulations made thereunder.
