Karnataka HC dismisses a batch petitions against SC’s ban on liquor shops

The Karnataka High Court on Tuesday disregarded a batch of petitions filed by liquor shop owners seeking directions to denotify a stretch of a national highway passing through Bengaluru and other towns and to renew their excise licenses.

A batch of petitions filed by the owners of Liquor shops located in City’s upmarket localities, against Apex Court’s decision of banning liquor shops within 500 meters from the outer edge of National Highway, or State Highway or service roads associated with the main Highway.

The Ministry of Road Transport and Highways said that it is not in a position to move against Sc’s order and consider the State Government’s proposal of denotification of these Nhs. They also submitted that State’s proposal to denotify 147 isolated NH stretches of around 609 Km length as “Bypasses have not been commissioned for these stretches”.

The petitioners claimed that these roads are not the part of NH, requesting their excise licenses to be renewed.

Justice Kothari dismissed the petition of bar and restaurant owners saying that this Court cannot exercise the jurisdiction in view of the Supreme Court order.

Center refused to denotify National Highway passing through Bengaluru, and other cities in Karnataka.

The Karnataka Government following the direction of Supreme Court on banning the liquor shops within 500 meters from the national highway, appealed the Ministry of Road Transport and Highway to consider denotify some stretches in Karnataka. 

Center Government in its communication dated August 14, 2017, explained technical reasons for the refusal and stated that it is not feasible to favorably consider the proposal to denotify the isolated stretch of 609.65 Km aggregate length.
