Copyright Infringement Delhi HC Directs Telegram To Disclose Information Of Users Involved

New Delhi: The Delhi High Court has ordered Telegram, a mobile messaging platform, to disclose information such as internet protocol addresses, mobile phone numbers, and devices used to function channels implicated in copyright infringement cases.

The court was hearing a case brought by a teacher named Neetu Singh against Telegram and unknown individuals. According to Singh's petition, videos of her lectures and books on competitive exams are regularly uploaded to Telegram. She also mentioned that students have discounted access to the material.

"The infringement must be stopped... The court cannot continuously monitor such infringements, so the origin and source of the infringing material must be traced and such gadgets or individuals involved in the infringement must face legal consequences, along with being held accountable for damages," the judge ordered.

Telegram claimed that disclosing user information would violate its privacy policy as well as the laws of Singapore, where the messaging service's physical servers are located.

If this argument is accepted at a time when most data is transmitted via online messaging services, "intellectual property violations would go completely unchecked," according to Singh.

The judge went on to say that just because Telegram does not have servers in India does not absolve Indian courts of copyright issues.

The court also stated that Telegram's compliance with Singapore's local law, the Personal Data Protection Act, 2012, cannot be used to justify not sharing user data.

The court stated that the screenshots as well as other proof shared by the plaintiff make it clear that the Telegram channels are profiting from Singh's works.
