Allahabad HC Judge issues Show Cause Notice to Advocate for Threatening Court Staff


Allahabad High Court Judge Suneet Kumar has issued a show-cause notice to an advocate as to why he may not be debarred from entering the court premises till the disposal of the notice. The order has been passed by the Judge on September 30, 2019, acting upon a complaint received from the court staff for getting threatened and abused by the said advocate.


The HC Judge was hearing a writ petition filed by Advocate Akash Mani Tripathi on behalf of one Padmakar Tripathi against the State of UP & Ors with regards to some discrepancy in petitioner’s salary under the UP High Schools & Intermediate Colleges (Payment of Salaries of Teachers and other Employees) Act, 1971. The petitioner was working as in the primary section of a School in UP on the post of Assistant Teacher.


The court passed the following order after receiving a complaint from the court staff regarding misbehavior and threatening by petitioner’s advocate Akash Mani Tripathi with regards to an order not being uploaded on the High Court website.

The case stands released.


It is informed by my staff that Sri Akash Mani Tripathi, Advocate, appearing for the petitioner in the instant writ petition had approached the office of my staff in my absence today i.e. on 30 September 2019, at 12.30. PM. Sri Tripathi used derogatory language threatening the members of the staff with dire consequences. It is further informed that Sri Tripathi threatened to cause injury to the staff outside the Court premises. The threat was made to the staff in the office of my Chamber, as well as, in the presence of other persons in the gallery.


Grievance of the learned counsel for the petitioner is that his order has not been uploaded. As a matter of rule, no mentions are accepted in Chambers pertaining to court proceedings or orders.


The conduct of Sri Tripathi in threatening the staff is unbecoming of an Advocate.


Issue notice to Sri Akash Mani Tripathi, learned Counsel for the petitioner, through Registrar General of this Court, to show cause as to why he may not be debarred from entering the premises of the High Court, pending disposal of notice.”

 The matter has now been fixed for further proceeding on October 18.
