Nikesh Tarachand Shah vs Union Of India on 23 November, 2017


Subsequent to this landmark judgement the amendment was made to undo the affect of this judgement and the words [under this act] were added to replaced [ under Part A of the Schedule]. 

Since then different High Courts have taken different view of the affect of this judgement and the subsequent amendment on the Judgement.
The issue of Bail under PMLA remain contentious issue and this landmark judgement is still being quoted by defence counsels and being opposed contentiously by the counsels of ED.
