GENEVA CONVENTION


The end result of Arbitration is passing of Arbitral Award. As we all know that Arbitral Awards are binding in nature. This means that the parties have to mandatory follow the instructions of such award and that they are enforceable by law.

When any case is solved domestically,the domestic laws of that country are applied and enforcement of an Arbitral Award is comparatively easy. Meaning thereby, when the parties to an arbitration matter are from within the same country, either party can seek enforcement of the Arbitral award given by the arbitrator.

But the problem arises when when the dispute is between two or more parti#powers #1996 #arbitration #conciliation #actes who belong to different countries. The main question that arises in such a case is that which country’s laws will be applicable to the parties.


The Geneva Convention mainly focused on the enforcement of International Arbitral Awards, which are also called foreign awards. The Convention talks about how the foreign awards to be implemented to the domestic country. The main motive of the convention is to enable the contracting signatory parties to get their awards enforced.
