DEFAMATION

Defamation can be both a civil and a criminal wrong in India. The remedy for such an offence is given under Law of Torts. A person can also move to Courts of law to seek damages in the form of monetary compensation from the accused. The person held guilty of defaming the other person can be sent to jail for two years under Section 500, Indian Penal Code.

The present paper focuses on the essential ingredients of defamation, and the process of lawsuit and remedies and defences against it.
