Anticipatory Bail Before the Sessions Court


The Anticipatory Bail is addressed in Section 438 of the Criminal Procedure Code. This clause encourages a person to obtain bail in anticipation of an arrest on allegations that he has committed a non-bailable offence. It is a way to free an individual on bail, given well before the individual is arrested.
