Withdrawal Of The Consent By  Justice AK Sikri For Nomination To Commonwealth Secretariat Arbitral Tribunal, 2019

Justice AK Sikri was nominated to this post in London based CSAT, by Central Government, last month and supposedly he withdrawn his approval to be appointed to the post of president/member of the Commonwealth Secretariat Arbitral Tribunal. This lead to a rise in controversy, therefore, the wake of decision of a high power committee decided to remove Alok Verma from the post of CBI Director. The committee also had a judge as its member.

 Basically, CSAT is London based tribunal constituted for firmness of disputes engaging Commonwealth international or intergovernmental organizations. To this tribunal members are selected by Commonwealth Governments on a regionally representative source from a high moral character person(s), who must hold or have held high judicial office in a Commonwealth country or who have at least ten years experience as a juris consults. So, on a four year term the members are appointed which may be renewed only once. The Tribunal composes of a panel of three including the President and two other members selected by the President.

The Supreme Court set aside the 23 October, 2019 orders of the Central government and the CVC depriving CBI Director Alok Kumar Verma of the charge of the probe agency. However, in the view of the allegations against Alok Verma was left open to be considered by the Committee in regard of the issue of suitability to continue him as a CBI Director.

 The Committee was directed to take a call on this within a week. On Tuesday (23 October), the Chief Justice of India Ranjan Gogoi nominated senior most SC Judge Justice AK Sikri to be part of this high powered committee.

On 25 October, the committee comprising of the PM Narendra Modi, Justice A K Sikri (CJI nominee) and Leader of Opposition Mallikarjun Kharge, assembled to contemplate the allegations against Alok Verma. A decision was made by the committee to remove Alok Verma from the post of CBI Director and transferred him to the post of Director General Fire Services.

In the held decision the dissent of Kharge was observed. Hence, Justice A K Patnaik, the former SC judge who was appointed to monitor the CVC probe against Alok Verma, beamed out against this decision of the High Powered Committee, that committee decision to remove  Alok Verma as CBI Director was impulsive.
