Victim’s Mother Filed False Affidavit Alleging Detention Of Daughter By Local Police: Reprimanded By The Allahabad High Court

The Allahabad High Court on October 21, 2020, had reprimanded the mother of a gang-rape victim for filing a false affidavit alleging the detention of her daughter by the local Police. Court has intervened in the matter noticing the delay of 3 months in lodging of FIR by the state police. Court has taken cognizance from the next day of lodging FIR that “Today, a personal affidavit has also been filed by Smt. Kunti, mother of the girl (victim), wherein she has stated that the girl in question (victim) has been detained in the police station by the police authorities since 16.10.2020. It is further stated that the police is not permitting the family members of the petitioner to meet the girl victim”. 

On October 15 police officials forced the victim to run through the pillar to post to get FIR registered, which further invited the wrath of the Court. In a special enquiry by the Court, the victim admitted that no detention was made, turning the mother’s affidavit to have appeared false. Bench taking cognizance of poverty, illiteracy, and being helpless has warned the mother for similar conduct not to take place in the future.

The Court has directed the Senior Superintendant of Police, prayagraj to protect the victim and her family and to ensure that the investigation in the matter must be concluded expeditiously under the law. Further, the Bench of Justice Shashi Kant Gupta and Pankaj Bhatia expressed disappointments for the negligent behavior of erstwhile SHO, currently on suspension, who despite being directed by the SSP several times hadn’t registered the FIR.

“Such gross negligence and laxity on the part of the Police Department is highly deprecated and such gross negligence, and if we may say so 'callousness is unbecoming of the conduct of a responsible officer entrusted with the obligation of performing the duties of a Public Office”- the Bench observed and said that strict actions shall be taken against such persons under the law.

The Bench directed SSP, Prayagraj to ensure that FIRs to be lodged promptly, especially when related to matters dealing with women safety and children protection.
