Venkaiah Naidu rejects impeachment notice against CJI; terms it legally untenable

New Delhi: Post receiving of opposition notice for impeachment of Chief Justice of India  Dipak Misra, Rajya Sabha Chairman and Vice President of India M. Venkaiah Naidu  rejected the Opposition’s notice calling it based on "suspicion and conjectures".

The 10 page order deals with the charges in detail. In his order Mr. Naidu observed, "The Hon'ble Members of Parliament who have presented the petition are unsure of their own case. Page 1 of the petition uses phrases such as 'the facts and circumstances of the Prasad Education Trust show prima facie evidence suggesting that the Chief Justice of India 'may have been' involved in a case of illegal gratification..."

While dealing with the charge on CJI on ante-dating of administrative the VP opined that the honorable members have themselves expressed a mere suspicion, there is no supporting evidence. As regards charge that CJI allocates cases to friendlier benches, the VP said, SC has itself decided that the CJI is master of roster. About the charge of proved misbehaviour under article 124 of the constitution ,the VP said conversation between third parties with questionable credentials cannot be treated as material evidence against as high an office as CJI.


The VP accorded the matter highest priority as it dealt with the prestige of the highest legal office in the country. To arrive at a decision, the VP consulted Attorney General of India K.K. Venugopal and retired Supreme Court Judge Sudarshan Reddy. Mr. Naidu also spoke to former Secretary General of the Lok Sabha Subhash Kashyap, former Law Secretary P.K. Malhotra and former Legislative secretary of the Rajya Sabha Sanjay Singh, apart from senior officials of the Rajya Sabha Secretariat.
