Union government order brings OTT platforms too under direct control

An order was issued by the Central Government to transfer all OTT platforms such as Netflix, Amazon, Prime video etc, under the control of Ministry of Information and Broadcasting. This order was signed by the President of India. Before this particular order, there was no autonomous body which used to regulate online media platforms. Currently print media is being regulated by The Press Council Of India, news channels are being regulated by News Broadcasters Association, and films are being regulated by Central Board of Film Certification.

In the month of October, Supreme Court had asked for a reply from the Centre on a particular petition asking for regulation of OTT platforms by an autonomous body. In the month of November, the Union of India had issued a notification by bringing online news platforms and online content providers under the control of Ministry of Information and Broadcasting.

According to the notification, the new rules must be called as Government of India (Allocation of Business Rules) Three Hundred and Fifty Seventh Amendment Rules, 2020 and this particular amendment must come into force immediately.

The notification also stated that, in the second schedule of Government of India (Allocation of Business Rules) 1961 under the heading ‘Ministry of Information and Broadcasting’, there are few new entries which have been inserted. As per the new entries, Films and audio visuals must be available on online platforms and news and current affairs content also must be available on online platforms. The Central Government will now control online news and current affairs and it will also control digital platforms, OTT etc.
