Two officials dismissed by the SC for tampering with order directing personal appearance of Anil Ambani

Two court masters Manav Sharma and Tapan Kumar Chakraborty has been summarily dismissed by the Supreme Court as they tampered with the January 7 order directing personal appearance of Reliance Communication's Chairman Anil Ambani reported by the Telegraph. The Chief Justice of India Ranjan Gogoi passed the order on the evening of 13th February, exercising his disciplinary powers as the administrative head of the court.

The bench of Justices R F Nariman and Vineet Saran passed this order, and demanded personal appearance of Anil Ambani in the contempt petitions filed by Ericsson. It was specifically made clear by the bench that personal appearance must not be dispensed with, the uploaded copy of the order on the official website of the top court stated personal appearance is dispensed with.

It was stated in summon issued to the Ambani that 'personal appearance is dispensed with'. Thebench noticed this discrepancy on January 10 on the direction given byDushyant Dave, senior counsel appearing for Ericsson. The bench headed by JusticeNariman was shocked by this discepancy, and clarified that the presence of Anil Ambani is specially requiredtherefore a revised copy of the order was uploaded again.

A probe was initiated regarding the circumstances under which the wordings in the copies of the order uploaded in the website and served on Ambani happened to be changed.

CJI Ranjan Gogoi had to exercise his powers to summarily dismiss the officers because tampering was revealed in the preliminary enquiry. Allegation that are being faced by the Ambani is failure of RCom to honor the unconditional undertaking made before Court to pay off the dues worth Rs.550 crores of Ericcson amounts to contempt of Court. Two deadlines set by the Court have been missed by the Rcom to clear the liabilities.

 Order in the matter has been reserved by the bench Yesterday.
