THERE HAS TO BE A DIRECT NEXUS BETWEEN THE SUICIDE AND THE ALLEGED LEADING CIRCUMSTANCES: Supreme Court

The accused was charged under Section 498A and Section 306 of the Indian Penal Code. He was acquitted by the Trial Court but got convicted by Himachal Pradesh High Court.

Restoring the Trial Court's order, the High Court's order of conviction was set aside by Supreme Court.
The observation of the Apex Court bench comprising Justice NV Ramana and Justice S. Abdul Nazeer, on the matter, is that the alleged incidents due to which the deceased, the accused person's wife had committed suicide, had happened way before her act of committing suicide. Also, that these incidents have had happened a long back before the suicide. Therefore, they cannot be held as the reasons for suicide being the cause of provocation.

An evidence was adduced before the Court to prove that the reason of suicide was the accused persons acts. But the Apex Court was not so convinced with this evidence, which was in form of a letter. In the bench's view, the deceased is not the rightful writer and the letter might have been written under suspicious circumstances.
Thus, an important point highlighted by Supreme Court in the present case is that in order to prove certain circumstances as the cause of suicide, the suicide has to be committed within a reasonable time after the occurrence of those circumstances.
