The law commission recommended the Human DNA testing should be used only for identification purposes

The Law Commission has suggested of establishing a new legislation on DNA Profiling Board only with the end goal of identifying unknown dead bodies and missing individuals, not to “harvest” other personal information.

The Bench of Law Commission headed by Justice (retd) B S Chauhan has proposed the establishment of the Board.

DNA Profiling is essential to discover the identity of disaster victims, missing individuals, human remains, helpful to crack criminal cases, and in medical research purpose.

The report indicates that the responsibility of setting up DNA data banks on a national level and territorial Data banks on state level will be charged to the central government.

These banks will be in charge of safeguarding DNA profiles, collected from the certified DNA research facilities and keeping up certain records for multiple classes of data like criminal cases, missing individuals, unknown dead bodies, etc.

It has additionally suggested that the DNA Board will lay down the methodologies and models to build up DNA labs for sample collection and processing.    

The DNA board will also be accountable for setting up the guiding principles of training programs for police personals and other investigating agencies on how to handle the cases which require DNA identification and teach them about the “moral and civil rights” related to DNA testing.
