The High Court of Bombay freezes the properties of a businessman after he fails to pay the maintenance to his wife and daughter

The High Court of Bombay has prohibited a Mumbai-based businessman and his parents to create any third party rights in any of their property whether movable or immovable. The order comes after the said businessman failed to pay the pending dues of maintenance to his wife and daughter.

Justice Prasanna Varale and Justice Milind Jadhav who were hearing the matter also ordered the businessman to submit the details of all the movable and immovable properties owned by him and his parents.

These directives arose out of a petition which was filed by his wife regarding the non-compliance of a metropolitan magistrate’s order on June 30th, 2018. The order by the metropolitan magistrate issued directions to the businessman ordering him to pay the interim maintenance of Rs 75,000 per month to his daughter and Rs. 1,50,000 to his wife.

The wife through this petition has claimed that the husband has not cleared the arrears of more than Rs. 44 Lakh with respect to the interim maintenance. It was also pointed out that another division court had ordered the Mumbai-based businessman to pay the pending amount before the next date but that order was not complied by him either.

The businessman reverted to this contention by saying that he had already paid Rs. 15Lakh to his wife but could not pay more as he was facing difficulties due to the Covid-19 situation. Furthermore, he also offered to deposit Rs. 5 Lakh more into his wife’s bank account in the coming week.

However, the court was not satisfied with the contentions raised by the husband and further issued a restraining order with respect to the movable and immovable properties owned by the husband and his parents. The restraining order was issued with the reference of the properties owned by the husband and his parents, given by the wife.

The matter is supposed to be heard further in the next two weeks.
