NEW DELHI: On Tuesday, 16th June, 2020 the Supreme Court of India clearly denied the  “circulation” of the study by forensic auditors by lawyers on the accused Amrapali Community.

The apex court will hear the appeal of the owners of the properties from April 30 onwards and decide if the ownership can be transferred to them. The Apex court may also direct the Builder to complete the stalled projects.

It said the group has a liability of more than Rs 5,000 crore towards the authority Noida and Greater Noida and has to decide the legal question as to how to give home buyers the title of their properties.

The bench said, “Let us take the final call on the issue which has been pending for long. We will not pass piecemeal orders or interim orders now. We would like to hear the issue finally and fix the liabilities. It is the home buyers who have to be benefitted from this entire issue who have invested their money but were not given their homes.”

This said the court needed to consider the sums confiscated from the home owners and said, “Whoever plays with the public money can't get free.”

The court allowed the Amrapali Group Chander Wadhwa Chief Financial Officer ( CFO) to deposit Rs 1.21 crore of money from home buyers that was with him.

The National Buildings Construction Corporation (NBCC), which had been previously ordered by the  Apex court to build Amrapali's stalled scheme, told the bench that it had built 17 flats in the Group's two ventures.

The Supreme Court on February 28 allowed the Delhi police to arrest and interrogate in custody Amrapali group CMD Anil Sharma and two directors on a complaint that they cheated home buyers from their different housing projects and duped their funds.

The top court, which is seized by many petitions from home buyers demanding ownership by nearly 42,000 flats booked in Amrapali group ventures, has ordered attachment of CMD's personal property and directors — Shiv Priya and Ajay Kumar.

The Apex court further stated that the only party who should reap the benefit is the hassled home buyers who have invested their earnings but have not been given their flats.
