The Economics Times- Vijay Mallya's Extradition cleared by UK

“The United Kingdom Home Secretary Sajid Javid signed the directed to extradite liquor baron Vijay Mallya to India, reported the Economic Times on 5 February, 2019.”

ET Report laid down: It was confirmed by UK Home Office that Sajid Javid having carefully considered all relevant matters signed the order on February 4.

On 10 December 2018, the Westminister Magistrate's Court in London, UK, directed the extradition of businessman Vijay Mallya to India. India’s demand for Mallya’s extradiction on charges of fraud and money laundering was accepted by the Chief Magisrate Judge Emma Arbhuthnot.

For an appeal to HC Mallya has the option against the extradition order. Mallya’s has dues net worthy Rs.9,000 crores in Indian banks. Hence, on January 5, he was declared a Fugitive Economic Offender by a special court under the FEO Act. The Enforcement Directorate had gone to the special court for FEO Act for this purpose. The agency requested the court that Mallya who is currently in UK, be declared a fugitive and his properties be confiscated and brought under the control of the Union government as provided under the act.

Therefore, the application of the ED is partly allowed. As mentioned by judge M S Azmi in the said order that Mallya is stated as Fugitive Economic Offender under section 12 (i) of the FEO Act. The FEO Act clearly states that “A person can be declared a Fugitive Economic Offender if a warrant has been issued against him for an offence involving an amount of Rs 100 crore or more and he has left the country and refuses to return.”
