The case of taxation on Senior lawyers are set to be heard in Delhi HC

The Supreme Court bench comprising Justices Madan B Lokur and Deepak Gupta, has transferred the petition related to imposing Service Tax on Senior Advocates in the hands of Delhi High Court, on the basis of a transfer petition filed by Centre, requesting all the similar petitions filed in various State High Court to be moved to Delhi High Court.

On behalf of Central Government, Solicitor General Ranjit Kumar presented that many petitions related to the same issue has been pending in different High Courts and needs to be assembled at one place for a composite evaluation. The States in which the issue has been raised are Allahabad, Calcutta, Kerala, Gujrat, Haryana, Punjab, Telangana and Andhra Pradesh.

The Respondent opposed the same, contending that no issue remained after Clarification issued by the Center that Service Tax and now GST, shall be paid on “reverse charge” basis.

In the 20th GST Council Meeting, led by Union Finance Minister Arun Jaitley held a number of decisions on services under the new Tax regime wherein he clarified that Tax on services offered by Lawyers including Senior Advocates and law firms would be applicable on a Reverse charge basis.
