Tax case: Prannoy Roy gets relief from Delhi High Court

New Delhi: A Delhi High Court bench of justices S Ravindra Bhat and A K Chawla quashed tax tribunal order in Prannoy Roy’s tax case. The court rejected the second order of Income Tax Appellate Tribunal (ITAT) which allowed the I-T department to place additional evidence before it, without issuing notice or giving a hearing to Prannoy Roy and his wife Radhika Roy. It also set aside the order of the ITAT which allowed plea of I-T department for early hearing on an appeal by Prannoy Roy and his wife against tax demand without giving them a notice.

The bench termed ITAT’s opinion “erroneous and is accordingly set aside”.

The NDTV founder and his wife had challenged the validity of the two ITAT orders on the ground that, first they were passed in an “unusual manner” and second the tribunal had accepted the plea of IT department for placing additional documents which were not part of the record.

The couple told the court that I-T department made a plea for early hearing of their appeals pertaining to I-T notice for their returns filed for assessment years 2009-10 and 2010-11 without their knowledge. They were not given any copy or notice. They further submitted that ITAT refused to accept their version of the assessment about early appeal. The argument of the counsel for ITAT that assessee had not submitted the documents which they promised to do so, was rejected by the court. The court said the ITAT has to follow proper procedure.
