Supreme Court to Vice Chancellors : Face contempt if lawyer verification not complete within 8 weeks

In a significant order, taking a tough stand against the universities for not complying with its earlier order the Supreme Court has directed that the process of verification of lawyers be completed by July 31.

The Bench of Justices Pinaki Chandra Ghose and Rohinton Nariman also directed that the Bar Council Elections for Delhi  be conducted by August 31.

As a guarantee to ensure the effective implementation of the order, the Vice Chancellors of law schools have been directed to remain personally present in court to face contempt proceedings.

The direction came even as the Bench was seemingly miffed at how many times the elections have been delayed. A visibly outraged Justice Nariman noted,

“You tell us why we should hear you in the first place. You were supposed to hold elections in December 2014. And you have dragged it until now.”

Even as the counsel appeared to try and convince the Bench otherwise, it seemed the Bench was in no mood to allow it.

The judges then proceeded to discuss between themselves the possible way out, and Justice Nariman was heard remarking,

” we make it clear that if the universities don’t comply with the order, the Vice Chancellor of concerned university to appear in person before the court and face the consequences under the Contempt of Court Act. Vice Chancellor must face contempt. That’s the only way they’ll understand.”

The Bench then dictated the order in which it set out specific dates for the completion of the verification and the election process.

In March this year, the Supreme Court directed law universities not to charge any fees for verification of lawyers. This, after it was found that that universities were demanding Rs. 200 to Rs. 2000 per person for verification of lawyers under the BCI (Certificate of Practice) Rules.
