Supreme Court does not grant any relief to the South Korean company LG Polymers to deposit Rs.50 crores in the light of the tragedy as per the NGT order

On Tuesday, the Supreme Court denied issuing a notice on plea filed by South Korean company LG Polymers against NGT's order directing it to payRs.50 crores to the District magistrate in Vishakhapatnam. The apex court also established a fact-finding committee to gather information about the dangerous tragedy.

Justice U U Lalit along with Justices Mohan M Shantanagoudar and Vineet Saran stated, “In compliance of the NGT Order, Appellant has deposited an amount of Rs. 50 crores. Questions raised by the Appellant are purely legal in nature. Give liberty to Appellant to raise the appropriate concerns before the NGT before the next date, which is June 1st

The company also challenged the fact that how the NGT could take suo moto cognizance of the incident and form a fact-finding committee headed by former judge of the High Court, Justice B. Seshasayana Reddy, when the High court had already seized the matter. Mr. Rohatgi, the learned counsel for LG polymers, said that the company had no intention of making any deliberate roadblocks and had already deposited the amount of  50 crore with the district judge as ordered by the NGT.

The NGT had formed a committee on May 8 to, “specifically report on the sequence of events, causes of failure and persons and authorities responsible, extent of damage to life, human and non-human, public health and environment — including water, soil and air, steps to be taken for compensation of victims and restitution of the damaged property and environment and the cost involved

The Supreme Court merely told the company to raise these questions as the case will come up for hearing on June 1st. It held the petition of the company pending till June 8, for further consideration.
