Sunanda Pushkar Case: Delhi HC Issues Notice To Delhi Police And Swamy, Refuses To Restrain Swamy From Going To Media

On Monday, The Delhi High Court issued notice on a plea filed by Sunanda Pushkar’s son Shiv Menon questioning the locus standi of Dr. Subramanian Swamy in the Sunanda Pushkar Murder Case.

But the HC refused to pass any order restraining Swamy from posting about it on Twitter or going to media on the issue.

“It is a matter of concern that charge-sheet is not filed in the case. We want to know from the police why no progress is made in the case, “the court said.

“How are you affected? You should be happy that the petition is in your favour. Ultimately we want an answer from the police why the charge-sheet has not been filed even after 3 and 1/2 years,” a bench headed by Justice GS Sistani said.

It also declined to pass a direction to Delhi Police not to supply a copy of the status report pertaining to Pushkar’s death to Swamy.

The 24 year-old Shiv Menon, son of Pushkar’s first husband, had moved the Delhi High Court seeking court to implead him in the petition filed by Swamy for CBI or SIT probe into Pushkar’s death.

Shiv’s counsel senior advocate Vikas Pahwa argued his client, being the son of the deceased, was affected.

Questioning Swamy’s locus in the case, Pahwa contended that Swamy was indulging in publicity. He circulated the petition to the media even before the court took it for hearing.

He also sought a restraining order against Swamy.

The bench, however, declined to pass any order, saying, “We can’t stop. Is there anything to hide?”

“We have not entertained Swamy’s petition. Not even issued the notice. No cognizance was taken. Only Delhi police standing counsel said he would file the status report. We allowed that,” it said.

Countering Pahwa’s argument, Delhi police counsel Rahul Mehra told court that the police were yet to file the status report after consulting senior police officers in the case.
