Second National Judicial Pay Commission Report: SC shocked as 20 States still pending to reply

On Wednesday, 4th November, 2020, The Supreme Court of India passed a peremptory order demanding a reply from the State governments to be submitted within 5 weeks about proposition of the Second National Commission Report. Supreme Court has warned that if any state does not follow this order then the Chief Secretary of that State has to appear before the Court on the given date. The bench comprising of Chief Justice S.A. Bobde and Justice A.S. Bopanna and Justice Ramasubramanian, with surprise said that 20 states have not responded and have not filed their replies to this order.

The Commission had submitted and mentioned in the Final report on January 29, 2020 that there should be an increase in salary, pension and allowance for all Judicial Officers. This Commission body was established in the case of the All India Judges Association by the Supreme Court according to its orders. The Commission Report says that earlier a Civil Judge and a First Class Magistrate’s starting salary was Rs. 27,700 which has been increased to Rs. 77,840. A Senior Civil Judge will receive salary of Rs. 1,11,000 while a District Judge will receive Rs. 1,44,840 which can be increased to a maximum of Rs. 2,24,100. .

According to the Commission Report, pension will increase by 50% and family pension will increase by 30% of the last drawn amount. It was recommended that when the Dearness Allowance reaches 50%, retirement gratuity and death gratuity should increase by 25%. Child Education Allowance, Transport Allowance and Home Expenditure Allowances were newly proposed in the Report.
