SC takes suo motu cognisance of vacant posts in subordinate courts

In the wake of the huge number of posts lying vacant in the subordinate judiciary across the country, a bench of Chief Justice Ranjan Gogoi and Justice Sanjay Kishan Kaul took suo motu cognizance to speed up filling up of 5,133 vacant posts out of a total of 22,036 posts in the subordinate judiciary.

In this connection, the SC bench has directed all High Courts and state governments to furnish the following details to the registry of the apex court by October 31:

  1. The dates on which the recruitment process/processes had been undertaken – for the posts of “Higher Judicial Service” and “Lower Judicial Service” and the timeline within which the appointments were to be made.
  2. Whether the time expected to be taken to complete the ongoing process/processes can be shortened and the process/processes completed before the time schedule spelt out (by the SC) in Malik Mazhar Sultan case.
  3. The top court also asked HCs and states whether the manpower and infrastructure available in different states are adequate to tackle the huge pendency.

Listing the matter for further hearing on November 1, the bench appointed four amici curiae — senior advocates Shyam Divan, K V Vishwanathan, Vijay Hansaria and advocate Gaurav Agrawal — to assist the court in the matter.
