SC Slaps Rs 10 Lakh Fine on IT Department for ‘Misleading It’

A Supreme Court bench of Justices MB Lokur, S. Abdul Nazeer and Deepak Gupta on Monday imposed a fine of Rs 10 Lakh on the IT department for reportedly trying to mislead it.

The SC bench slapped the penalty on the Commissioner of Income Tax (CIT), Ghaziabad.

The court was hearing a petition filed by the CIT, wherein the department had submitted that a similar case was already pending before the Supreme Court. The petitioner’s lawyer told the SC bench that the new case should be tagged along with the previous case that has been pending in the top court since 2012.

The bench, however, noted that the registrar's office has submitted a report that the old case had already been decided by the SC as far back as in September 2012.

In other words, the petitioners have given a totally misleading statement before this Court,” the bench then observed.

Appalled at the casual approach taken by the department towards the matter, the court came down heavily upon the lawyers, appearing for the department, for trying to hoodwink the top court.

We are shocked that the Union of India through the Commissioner of Income Tax has taken the matter so casually,” said the bench.

The bench further noted that the Commissioner of Income Tax could not provide an adequate explanation of the delay of 596 days in filing the petition and a misleading statement about pendency of a similar civil appeal.

The court then dismissed the petition directing the department to deposit a sum of Rs 10 Lakh to the Supreme Court Legal Services Committee within four weeks. The amount has been directed to be used for “juvenile justice issues”.
