SC slams DDA :  Ask court appointed committee to resume sealing of illegal structures

New Delhi: Coming hard on Delhi Development Authority (DDA) for not complying with its  February 9 order to submit proposed changes in the Master Plan 2021 before it,the SC bench comprising of Justices Madan B Lokur and Deepak Gupta said that this amounts to contempt of court for which they can even ask their Vice Chairman to appear in person. The court consequently asked the Centre, Delhi government and DDA  to put amendments in Master Plan on hold .This comes as a shot in the arm for RWA's which had been opposing amendments in the Delhi Master Plan 2021.

The SC ruling means  that the sealing drive will resume.

"What are you doing? You are telling the Supreme Court that you can do whatever you want to do. It is not acceptable. It is contempt of court and we can ask your vice-chairman to appear before us for not complying with our order. This 'dadagiri' has to stop ".

The court had on February 9 asked for responses from DDA, along with the Delhi government and the civic corporations,on the adverse impact of amendment of the Master Plan with respect to pollution, traffic congestion, environment, fire safety and population.

Post that the Ministry of Housing and Urban Affairs had held detailed consultations that aimed at changing floor area ratio norms to provide relief from sealing and also incorporate measures to curb the operation of pubs, restaurants and clubs in "mixed-use" areas. But they failed to put proposed changes in front of the SC.

The sealing resumed in January  after the SC allowed the court-appointed monitoring committee to identify and seal illegal premises as government authorities had failed to check building of such illegal structures.

Earlier the SC in March 2006 had ordered sealing of all unauthorised constructions in the city and to implement its order appointed a monitoring committee which was given job of conducting and monitoring the sealing drive.

This sealing was stopped in January 2012 when the court asked the committee not to proceed further as the government has brought in force the 2021 Master Plan for regularising some of the illegal structures.
