SC says it will soon ask Centre to issue notification for bifurcation of Hyderabad HC

A two-judge bench of the Supreme Court on Monday said it would soon ask the Centre to issue notification for division of the existing Hyderabad High Court into two HCs and setting up a new High Court building for AP, according to a report published in TOI.

The SC bench comprising Justices AK Sikri and Ashok Bhushan passed the order while reserving its verdict in a special leave petition filed by the Union Law Ministry. In the plea, the Law Ministry has urged the apex court to set aside the Hyderabad HC’s 2015 judgment – that preempted any attempts by the authorities to establish a separate AP HC in Hyderabad even on a temporary basis.

The counsel for Telangana state, Mukul Rohatgi, told the court that the state is facing a lot of problems relating to the recruitment of judges and court staff since the AP government has been delaying the bifurcation of the existing Hyderabad HC.

Also, both the Centre and Telangana state government alleged that the AP government has been avoiding the issue of establishing the required infrastructure, like the new court building, in its own state for running the AP High Court.

Responding to this submission, the SC bench said, “We want it to be bifurcated at the earliest.’’

At this point, the AP government told the court that its new High Court building at Amaravati will be ready by December, and the staff will be shifted by April 2019. Further, the AP government said that the residential accommodations for high court judges will be ready by August, next year.
