SC rejects plea to transfer AIADMK MLAs' disqualification case, appoints case to a new judge

A vacation bench of the Supreme Court today rejected a plea for transferring the case involving disqualification of 18 MLAs of the TTV Dhinakaran faction of the All India Anna Dravida Munnetra Kazhagam (AIADMK) from Madras HC to itself.

The SC bench comprising of Justices Arun Mishra and SK Kaul declined the transfer plea, and instead appointed a third judge – Justice M Satyanarayana – to hear the matter afresh.

The Madras HC had on June 14 delivered a split verdict in the Disqualification case.

Following the High Court verdict, the case was assigned to Justice Vimla as the third judge. However, the petitioners expressed discontent against Justice Vimla and expressed a lack of confidence in her.

The plea was filed by some of the disqualified MLAs, who urged the top court to transfer the petition challenging their disqualification by the Tamil Nadu Assembly Speaker from the Madras HC to the Supreme Court.

According to the petitioners, the Madras HC took around 6 months to deliver the judgement and that they fear that the appointment of the third judge might further delay the delivery of the verdict.

However, the SC bench in response said that the HC had delivered its judgement in 4.5 months from the initial date of hearing the arguments. Thus, the information provided by the petitioner is incorrect, the court said.

The SC bench also asked the petitioners to withdraw their statement made against Justice Vimla from their petition.

The court then ruled that the second senior-most judge of the top court would now hand-pick a judge who will oversee the matter afresh.
