SC orders shifting of Kathua gang rape trial to Pathankot

New Delhi: A bench headed by Chief Justice Dipak Misra and Justices D Y Chandrachud and Indu Malhotra in a ruling lifted the stay on a trial of the Kathua gang rape and murder case. Besides it shifted the trial to Pathankot and directed that the trial should be held in-camera, be fast-tracked and conducted on a day-to-day basis. The court made it clear that today's order only limited to shifting the trial from Jammu and Kashmir.

The top court also said the trial would be carried out in accordance with the provisions of Ranbir Penal Code, which is applicable in Jammu and Kashmir. The court ordered continuation of security to victim’s family member, her family friends as well as to the lawyer concerned. Further court also ordered that security provided to juvenile accused will continue. The court said trial should be fair to all the parties concerned. It further stated translation of all the case record from Urdu to English.

It also ordered continuation of security to the family members of the victim, family friends and lawyer representing them and directed translation of statements and records of the case from Urdu to English. With the court reopening only in July after the summer vacation, the top court fixed the next date of hearing also in July.

The case is about an eight-year-old girl from a minority nomadic community, who had disappeared from near her home in a village close to Kathua in the Jammu region on January 10. She was gang raped in a temple and her body was later found in the same area a week later.
