SC orders centre to draw policy to check illegal mining

New Delhi: The SC bench of Justices Madan B Lokur and Deepak Gupta came hard on centre for its failure to curb illegal mining across the country. It asked the centre to draw a policy framework to deal with the issue of rampant illegal mining, which has been happening in different Indian states.

The SC over a period of time has passed several orders to check the problem of illegal mining in Karnataka, Goa, Haryana, Uttar Pradesh, Rajasthan, Odisha, and Madhya Pradesh.

Despite all the orders, the SC's central empowered committee found evidence of illegal stone mining in protected forests in Western Bihar.

SC over the years has passed slew of orders to curb the menace of illegal mining. In August 2017, the court penalised the mining companies in Odisha ordering them to pay compensation of about Rs 17,576 crore for illegally extracting iron and manganese ore in the state since 2001. The court further ruled that the companies would be required to pay back 100 percent of the price of minerals mined by them in violation of law. 

The Supreme Court has been passing orders to check illegal mining regularly. First order was in 1997 when it had recommended that at least 20 percent of the profits be set aside as a permanent fund for regeneration of environment and for the benefit of those affected by mining. Further in 2002, the SC passed an order by which it declared any mining in Aravalli mountain range in Haryana and Rajasthan as illegal.
