SC issues notice to three states on contempt plea over cow vigilantism

The SC on Monday issued contempt notice to the governments of Haryana, Rajasthan and Uttar Pradesh, asking them to file a response to a plea on cow vigilantism.

The Supreme Court was hearing a plea filed by an activist, Tushar Gandhi, seeking contempt proceedings against the states for allegedly failing to implement the apex court’s order on preventing violence in the name of cow protection.

A three-judge bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud has asked the three states to file their replies by 3 April.

Indira Jaisingh, the senior advocate representing the petitioner, said incidents reporting violence in the name of protecting cows were still being witnessed in the states despite the SC’s order.

In its previous order issued on September 6, 2017, the court had directed all 29 states and 7 union territories to employ district nodal officers to control the increasing incidents of cow-related violence.

Additionally, the court had asked the chief secretaries to file status reports on steps taken to curb mob violence. It even asked the states to organize highway patrols, after it was pointed out that the cow vigilante group mostly targeted vehicles on highways – on the pretext that they were carrying beef.

The apex court had also directed the Centre to respond to the submission that it could issue directions under Article 256 (obligation of states and Union) of the Constitution to all state governments on issues related to law and order. The Centre, however, told the top court that it does not support any incident of “people taking the law in their hands”.

The bench said that it would hear the contempt plea along with Gandhi’s main writ petition on February 23.
