SC issues notice on plea for reinstatement of Judge Who Resigned after Alleged Sexual Harassment by HC Judge

A two-judge Bench of the Supreme Court today issued notice to the Registrar General of the MP High Court in a petition filed by a former judge seeking reinstatement in service.

The petitioner, who is a former Additional District and Sessions Judge, had levelled sexual harassment allegations against a retired MP High Court judge back in 2014, after which she was transferred.

Subsequently, she had resigned from the service.

Though an impeachment motion was initiated against the accused HC judge following the allegations, but it was later dropped after a Rajya Sabha-constituted committee concluded that the charges levelled against the judge were not proved.

The Committee – which comprised of the sitting SC judge, Justice R Banumathi, former Chief Justice of the Calcutta and Bombay High Courts, Justice Manjula Chellur, and Senior Advocate KK Venugopal – had made the following observation:

The allegations levelled by the complainant against the respondent judge are very grave and we do accept that fear of hierarchy exists in the system. But the delay in raising the issue of allegations of sexual harassment by the respondent judge raises serious doubts in our mind.”

In her petition before the SC bench the former Ad District Judge, however, prayed for reinstatement, alleging that her decision to resign was a consequence of the mala fide manner in which she was transferred to a conflict area for not accepting the depraved demands put forth by her superior.

Senior Advocate Indira Jaising appearing on the behalf of the petitioner stressed on the urgency of the matter.

The Bench, consisting of Justices AK Sikri and Ashok Bhushan, then issued the notice returnable in six weeks.
