SC issues notice in a plea to transfer rape case against UP standing counsel out of state

A notice has been issued by the Supreme Court to the Uttar Pradesh Government and SP on a petition for transferring the investigation on a criminal case which was filed against the Additional Chief Standing counsel of the UP Government for committing rape.

This particular petition has been made because the victim’s friend is sure that the investigation of the rape may get discreet due to the advantages which are being enjoyed by the accused in the state.

Justice R.F. Nariman, Justice Navin Sinha and Justice Indira Banerjee were hearing the plea and had issued notice to the Uttar Pradesh Government and SP regarding this particular case. According to the petition, after lodging the FIR by the victim at Vibhuti Khand Police station, surprisingly the news of the rape has been circulated to various news channels and social media platforms spreading the identity of the victim in front of the public.

The Council on behalf of the petitioner plead to the Supreme Court to pass the orders on Lucknow Police to immediately remove all the details of the victim from media and social media platforms. The Council also plead to the Supreme Court to order for transferring this particular case to the CBI and trail outside the State of Uttar Pradesh and also order to test all the samples of the victim in a FSL facility outside the State of UP.

Earlier, the Supreme Court had suspended the order of the Allahabad High Court granting temporary relief to the accused. The High Court of Allahabad granted Chauhan interim relief from arrest against which an appeal was brought before the Supreme Court.

The Court was of the view that the process of the disputed order shall continue, but as follows. The appropriate court is hereby instructed, as an interim move, to issue the required instructions on the pending complaint, so that the investigation agency may take care of the related information which may be applicable to the case
