SC issued notice against Kerala HC in a petition challenging District court Judges selection process, 2015

The Supreme Court today issued a notice to Kerala High Court in light of a fresh petition filed by six candidates challenging the selection process of District Court Judges, 2015.

The Bench comprising Justices Kurian Joseph and R Banumathi also stated that the hearing should be held on a larger bench.

In April, the bench issued a notice in the same petition filed challenging the selection process.

Advocate CN Sreekumar, representing the petitioner, proposed that the similar notice has already been issued against the Kerala High Court in this matter.

The court was hearing a petition filed by six candidates who participated in the selection process but failed to succeed. The petition contended that the Administrative Community of the Kerala High Court initiated new measures in the examination process by imposing a condition of 50% marks obligatory for clearing the exam in both written and viva voce.

During the trial, the bench observed that the hearing refers to the fixing of cut off marks to be discussed during the interview of the candidates. The petitioner claimed that the prescription of minimum cut off marks was declared after the selection process is over. The petitioner also added that the impugned direction passed by Administrative committee is in violation of Article 14 and 16 of the Constitution
