SC Dismisses Plea Seeking Directions to CBSE, Delhi Govt. to Waive Exams Fees for Class 10th and 12th

On Tuesday, 17Th November, 2020, Supreme Court had dismissed a petition which had asked for a direction to CBSE and Delhi Government to remove examination fees for class 10 and class 12 for the Covid-19 pandemic. The petition also stated that, due to this current situation many parents are facing financial crisis and also having problem in paying fees for the academic purposes of their children.

Justice Ashok Bhushan was hearing the plea and dismissed the same by stating that the court cannot take a decision on waiving of examination fees. This particular decision can only be taken by the Government.

This particular petition has been filed against an order of Delhi High Court dated 28th September, 2020, in which the Delhi Government and CBSE were asked to take a decision within three weeks, considering the rules and regulation and the policy of the government which is applicable in the facts of this particular case.

The petitioner in the plea had requested to remove 50% of the fees. The petitioner also stated that they have applied before the Delhi Government but the application was rejected and CBSE did not give any response to their application. The plea also stated that the Delhi High Court’s order had indirectly denied giving relief to approximately 30 lacs students across the country including 3 lacs students residing in Delhi.

The petitioner stated that in the academic year 2018-2019 the examination fees of CBSE Board was nominal, but in next year the Board had increased the fees and in this year CBSE Board had demanded Rs 1500 to 1800 for class 10 and Rs 1500 to Rs 2400 for class 12 as examination fees.

However, the bench had rejected the plea by stating that the Court will not interfere in this matter as this matter must be addressed before the Government.
