SC dismisses PILs seeking quashing of appointments of CVC and VC

The Supreme Court bench of Justices Arun Mishra and Mohan M Shantanagoudar on Monday dismissed the PIL challenging the appointments of Central Vigilance Commissioner (CVC) K V Chowdary and Vigilance Commissioner (CV) T M Bhasin.

Two writ petitions were filed by NGOs Common Cause and Center for Integrity Governance and Training in Vigilance Adminstration, alleging that Chowdary and Bhasin appointments were “arbitrary, illegal and in violation of the principle of institutional integrity”.

Representing the petitioner, advocate Prashant Bhushan argued that serious allegations were made against Chowdary and Bhasin but there were not investigated by the committee before appointing them.

Bhushan alleged that no action was taken by Chowdary in the controversial Niira Radia phone tapping case, despite being a senior official of the IT department.

However, advocate Bhushan’s claims were countered by the counsels of both the respondents.

While Chowdary’s counsel disproved the allegations, saying that “no shortcomings were pointed out in the probe into the Radia case”, Bhasin’s counsel said that the complaints made against him had no basis.

Responding to Bhushan’s allegations, the bench said, “Though there was no complaint, the aforesaid aspect which has been urged on behalf of the petitioners was looked into by the High Power Committee on the basis of inputs made. Thus, nothing adverse was found in the final conclusion in the matter of writing of the APAR (Annual Performance Appraisal Report)..”

The SC bench, then dismissed the two petitions saying that there is no ground to quash the appointments and the complaints made against the respondents are baseless.
