SC directs Gujarat Govt. to pay Rs.50 Lakhs compensation to Bilkis Bano within two-weeks


A three-judge SC bench comprising of Chief Justice of India Ranjan Gogoi, Justice SA Bobde and Justice S Abdul Nazeer was hearing a contempt petition today filed by Bilkis Bano, who is a Rape victim of the 2002 Gujarat Riots.


The bench directed the Gujarat State Government to pay a compensation of Rs. 50 Lakh, a government job, and accommodation to the victim within a period of two weeks from today.


Bano was earlier offered an amount of Rs. 5 Lakh as compensation by the State government in March 2019, but had turned down the offer while pressing before the Supreme Court to escalate the amount of compensation. The Apex Court had then ordered in April this year to the state government to pay a compensation of Rs. 50 Lakhs and provide a job and accommodation to Bano, as per rules.


The Rape survivor had presently filed a contempt petition against the non-compliance by the Gujarat State government of the above mentioned April order.


The Gujarat State Government was represented by Solicitor General Tushar Mehta, who informed that court that the reason for non-compliance by the top court’s order was because of the reason that the state government wanted the April order to be reviewed by the court.


The government wanted the Apex Court to reconsider its directive as it might set a detrimental precedent for other cases.


The CJI, while taking note of the issue, clarified amply that the said order to pay compensation and other benefits was specifically in view of the facts and circumstances of the present case and shall not be set a precedent.


However, the court rejected the plea raised by the state government of reviewing its order and directed the govt. to pay compensation to the victim within two weeks.


Bilkis Bano was just 19 years old and pregnant while she was gang-raped 22 times by several men during the 2002 Gujarat Riots. The whole family of Bano was mercilessly killed during the unfortunate incident. A total of nineteen men including six police officers and a government doctor were convicted for rape, murder and falsifying/tampering with evidence respectively.
