SC Collegium recommends one Judicial Officer for elevation to Orissa HC, rejects 11 names

The Supreme Court Collegium has recommended the elevation of one judicial officer to the Orissa High Court.

As per two Collegium resolutions dated October 31, the Orissa HC Collegium had recommended elevation of four judicial officers and eight advocates to the High Court.

However, the Collegium only recommended one judicial officer, Dr Akshaya Kumar Mishra, name for appointment as an Orissa HC judge. The recommendation was made on the basis of an appraisal of Mishra’s file and inputs of the Department of Justice and personal interaction.

 “In view of the above, the Collegium resolves to recommend that Dr. Akshaya Kumar Mishra, Judicial Officer, be appointed as a Judge of the Orissa High Court against the service vacancy which occurred on 23rd January, 2015.”

The SC Collegium, however, declined elevation of other judicial officers to the High Court stating that the officers do not qualify the prevailing norms of eligibility.

“…the Collegium is of the considered view that the proposal in respect of these three recommendees deserves to be sent back to the Chief Justice of the High Court for reconsideration by the present High Court Collegium at the appropriate time,” the SC Collegium said in regards to the judicial officers recommended for elevation.

Other than Mishra, the three other judicial officers whose names were recommended by the Orissa HC Collegium are Satyanarayan Mishra, Bibhu Prasad Routray and Gautam Sharma.

Besides, these judicial officers, the eight advocates who were considered for elevation by the Collegium were Rudra Prasad Kar, Pranaya Kishore Harichandan, Kali Prasanna Mishra, Bimbisar Dash, Narasingh V, Tushar Kanti Satapathy, Bishnu Prasad Pradhan, and Sameer Kumar Das.

But, the SC Collegium didn’t approve any of the advocate names for appointment as the Orissa HC’s judge citing various reasons.

The Supreme Court Collegium, however, has deferred its decision on the proposal for elevation of advocate Kali Prasanna Mishra and said that his case would be taken up for consideration by the Collegium after some time.
