SC bans Lifelong government housing to ex-CMs of UP, Rajasthan HC may follow

The Supreme Court order quashing a 2016 amendment, allowing former Chief Ministers of Uttar Pradesh to retain government accommodation for life, may impact a similar law passed by the Vasundhara Raje’s government in Rajasthan granting free government housing for ex-CMs for life.

Such development is expected, as the Rajasthan HC will hear a Public Interest Litigation (PIL) filed against entitlements to former chief ministers on July 12. The PIL was filed by a Jaipur-based journalist Milap Chand Dandia, who alleged that the perks provided to the ex-CMs were “unconstitutional”.

“Now that the SC has decided on the issue, I am hopeful that the HC will also quash the new section, which is unconstitutional and invalid, and set it aside,” said Dandia.

The Vasundhara Raje’s government passed the Rajasthan Ministers’ Salaries (Amendment) Act, 2017, during the budget session in April 2017. As per the provision of the Bill, “Chief Ministers of Rajasthan, who serves an uninterrupted five-year term, are eligible for a government residence, a car and a driver, a telephone and a staff of 10”.

The Bill also reads, “In the case, the said facility is not availed by some former chief minister, a fixed monthly amount will be reimbursed by the government”.

Ghanshyam Tiwari, from the rebel ruling party, was the only one who dissented the move and termed the Bill as a move to “revive feudalism” in the state.
