Same-sex marriage: Live telecast of proceedings not advisable, Centre tells Delhi HC

New Delhi: The proposal to live-stream the proceedings before the Delhi High Court in the petitions seeking recognition of same-sex marriages has been opposed by the Central Government.

The Ministry of Law and Justice told the High Court in an affidavit that the proceedings in the case are likely to be extremely charged and it will involve passionate arguments from both sides, which could elicit sharp and unwanted reactions.

In the recent past, serious unrest was caused as well as wild and unnecessary allegations leveled against sitting Supreme Court of India judges even when the proceedings were not fully live-streamed, according to the affidavit.

“It is well known that Judges cannot defend themselves in public fora and their views/ opinions are expressed in the judicial pronouncements,” according to the affidavit.

The government also stated that such live streaming could be edited or morphed, thereby destroying the sanctity of the proceedings.

It may be advisable that the proceedings not be telecast live to maintain the solemnity, dignity, and seriousness of court proceedings, especially in matters like the present one wherein sharp ideological schism may be prevalent, the government submitted.

The Delhi High Court is hearing several cases involving same-sex marriage under the Hindu Marriage Act and the Special Marriage Act.

According to the Centre's stated position, the law only recognizes marriages between biological men and biological women.

It had previously opposed live-streaming of proceedings, claiming that the case was not of national importance and that the demand for live-streaming of court proceedings in the matter was merely to gain sympathy.

The Court, on the other hand, expressed its displeasure with the affidavit and requested that the government file a better response.

It has now been suggested that such live streaming could be edited or morphed.

To maintain the solemnity, dignity, and seriousness of court proceedings, especially in matters where sharp ideological schism may exist, it may be advisable that the proceedings not be telecast live, the Central government asserted.
